Our contract
 
These terms and conditions govern the supply of goods between Clarke and Pulman Ltd Langley Place Burscough Industrial Estate Burscough Lancashire and our affiliates (‘’we and us and our’’) to the customer named on the order form on our website or in our catalogue or in store (‘’you and your’’). Together with the completed order form these terms and conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivering of the goods constitutes a legally binding contract between us. Please read these terms and conditions carefully. If you do not agree with them, do not use this website. Nothing in these conditions affects your statuary rights. By using our website you agree to be bound by our terms and conditions.

Pricing

3.1 All products offered for sale are in pounds sterling and include V.A.T at the prevailing rate where applicable. Any customs or import duties when the goods reach their destination are your responsibility. Occasionally, despite our best efforts, items appear wrongly priced; however, our order confirmation will verify all pricing. Clarke and Pulman Ltd reserve the right to change prices without prior notice

3.2 Subject to clause 3.3, we must receive payment in full for all the goods on order, via credit card or debit card, for payments by cheque goods will not be despatched until
All monies have cleared.

3.3 Trade customers wishing to open an account should apply in writing enclosing three trade and one banker’s reference. For trade customers only, all invoices for goods and services, will attract a credit charge of 10% of the total goods excluding V.A.T at the prevailing rate. If payment is made in full within 28 days of the invoice date you can deduct the credit charge. If payment is not received when due, interest is payable on the total outstanding amount at 4% over Natwest then current base rate from the due date of payment until receipt by us of the full amount (including any accrued interest), whether before or after judgement, together with any reasonable legal or other recovery costs.

Special order items

All items ordered specially or specifically such as those sourced outside our usual stock, manufactured, personalised or custom made are non- returnable.

Delivery and title

Unless you tell us you wish to collect the goods, we will deliver them in accordance with your order. A valid signature will be required on collection or delivery. Immediately prior to despatch of the goods to you, title in the goods will pass to you. If monies due to us remain unpaid, we are hereby authorised by you to enter your premises during normal working hours to take possession of and remove such goods.

Availability

While we endeavour to hold sufficient stock to satisfy all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substitute product or refund you the price paid for such goods as soon as possible and in any case within 30 days, or in the case of an account customer, we may, at our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you.
